These Terms and Conditions ("Terms") govern your use of the Damai Counsel website at damaili.sbs and the legal services provided by Damai Counsel ("we", "us", "our"). By using this website or engaging our services, you agree to these Terms. Please read them carefully before proceeding.

Details of each service and applicable fees are set out on this website and confirmed in a written engagement letter prior to commencing any work.

Our services are primarily available to individuals located in Malaysia. Where we agree to assist clients located elsewhere, we will address any jurisdictional considerations at the outset.

All content on this website — including text, layout, design, and graphics — is the property of Damai Counsel or used under licence. You may view and print content for personal, non-commercial use. You may not reproduce, distribute, or commercially exploit any content without our prior written permission.

Service fees are stated on our website in Malaysian Ringgit (RM) and confirmed in writing before any work begins. Current fees are:

Payment is accepted by bank transfer or other methods agreed at the time of engagement. Fees for services not covered by the above packages will be discussed and agreed in writing before incurring any additional cost.

Refunds: If you decide not to proceed following an initial consultation, no further fees are payable beyond the consultation fee. For ongoing engagements, any fees paid for work already performed are generally non-refundable, but we will discuss this with you fairly in the event of unusual circumstances.

7. Service Delivery

We will deliver our services with reasonable skill and care, in accordance with the standards required by the Malaysian Bar. Timelines will be discussed and agreed at the outset of each engagement, taking into account the nature and complexity of the matter. We are not responsible for delays caused by courts, other parties, or circumstances outside our control.

The scope of services is defined in the engagement letter. Any changes to scope that may affect fees will be discussed with you before proceeding.

8. Confidentiality

We observe strict solicitor-client confidentiality in accordance with the Legal Profession Act 1976 and related professional rules. Information you share in connection with your legal matter will not be disclosed without your knowledge and consent, except where required by law or the rules of the Malaysian Bar.

Either party may terminate an engagement by giving reasonable written notice. Upon termination, we will provide you with any documents or materials you are entitled to receive. Fees for work completed to the date of termination remain payable. Provisions relating to confidentiality, intellectual property, and dispute resolution survive termination.

13. Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising from or relating to these Terms or our services shall first be subject to good-faith negotiation between the parties. If unresolved within 30 days, disputes may be referred to the courts of Selangor, Malaysia, which shall have exclusive jurisdiction.
